The Code lists three permitted bases for an appeal. The first is "Violations of the appealing party's rights or other failure to follow the Student Conduct procedures that substantially affected the outcome of the initial hearing." The second is "New information which was not available at the time of the hearing and that the new information could have substantially affected the outcome." The third is that "The severity of the sanction is disproportionate to the nature of the charge(s)." On status while an appeal is pending, the Code states that "An appeal has no effect on a Respondent's status when the sanction was suspension or expulsion," and that in any other case "once an appeal is requested, the sanction(s) will be stayed and will not take effect until the appeal process has been completed." What any of this means for a particular case is for the institution and its process to determine.

2026-08-23 (second entry) — Both sources this page had been carrying by title and link only were read in full this date in a browser, and both are now quoted rather than characterized. The FIU-2501 Code PDF (effective June 16, 2025; 35 pages) was read end to end. Section 02 now quotes the Cheating definition from Section 6, six of the eleven rights listed in Section 11, and five provisions of Section 18 including the appellate officer, the file-review standard, the burden on the appellant, the filing deadline of 5:00pm on the seventh Business Day after the decision letter is delivered, and the consequence of missing it. The three permitted bases for appeal and the rules on sanction status pending appeal are also now given. The section-by-section pointer list that section 02 previously ended on is retained. A substantive finding from that read is recorded in section 01: the Code contains no occurrence of "artificial intelligence," "AI," "generative," or any comparable term anywhere in its text, and the only language reaching in that direction is the phrase "automated tools" inside the Cheating definition. This is a change in what can be said about FIU, not a change at FIU: the absence was previously unverified because the PDF had not been read. The Ed Tech Services faculty Turnitin page was also read and is now described from its own text — it distinguishes the Plagiarism Framework from Feedback Studio, names the Originality Check report, and names no AI-detection feature at all, which is worth setting beside the AI Indicator trainings quoted above it.
